§ 9.17 Enforcement, compliance date, State law.
(a) Enforcement. (1) Sections 9.16(a)(1) and (b)(1) and (2) shall be
enforced under title V of the Communications Act of 1934, as amended, 5
U.S.C. 501 et seq., except that section 501 applies only to the extent
that such section provides for the punishment of a fine.
(2) In the event of noncompliance with § 9.16(b), the person engaged in
the business of managing the multi-line telephone system shall be
presumed to be responsible for the noncompliance.
(3) Persons alleging a violation of the rules in § 9.16 may file a
complaint under the procedures set forth in § § 1.711 through 1.737 of
this chapter.
(b) Compliance date. The compliance date for this subpart F is February
16, 2020, unless otherwise noted. Accordingly, the requirements in this
subpart apply to a multi-line telephone system that is manufactured,
imported, offered for first sale or lease, first sold or leased, or
installed after February 16, 2020, unless otherwise noted.
(c) Effect on State law. Nothing in § 9.16(a)(1) and (b)(1) and (2) is
intended to alter the authority of State commissions or other State or
local agencies with jurisdiction over emergency communications, if the
exercise of such authority is not inconsistent with this subpart.
